There is something disgusting about Napoles turning into a state witness.

It’s adding insult to injury, a grain of salt in our open wounds. It not only mocks our faulty justice system, but ridicules us. A sick joke that only the accused will ever find funny. We’ve been swindled out of our billions, billions that could have been used to construct schools, hospitals, roads. Now it’s all up in the air –  a bunch of could haves, would haves, nothing but what we call  in grammar “the unreal conditional”.

Now the government wants to give the swindler a free pass. Stealing: It’s more fun in the Philippines. Napoles has her cake and eat it too!

Benhur’s camp is adamant and rightly so. The lady who lied under oath, who called him a liar, is now offering to tell all. The boat is sinking and she’s scrambling to save herself. She’s willing to do anything, forsake her business associates and throw them off to the sharks, if that’s what it takes. But she’s hardly staying afloat herself, and we know she’s going to drown anyway…her own “undoing” if I may say so..and then government suddenly sends her life raft. What? Why?

People can hardly be blamed for getting upset at this “on-going” tell-all deal with Napoles. I’m sorry, but isn’t this woman the most guilty of all parties involved, masterminding one of the biggest scam in all of Philippine history? She’s had her chance and she blew it big time. Now the prospect of spending her life behind bars scares her and she gets to change her mind? Why?

Others argued that there must be someone directing all these, the Maestro whose invisible hands pulled the strings and got the play into action. After all, Janet Napoles is but a high school graduate, hardly able to string coherent sentences together. I mean did you see the interview? Obviously, she’s not, as Smash Mouth put it in their Shrek song, “the sharpest tool in the shelf.”

But, doesn’t anybody remember Joseph Estrada, the college drop out aka former President of the RP, found guilty of plunder? During that time people argued Erap couldn’t have pulled the Velardo thing off by himself, well because he’s just so dumb he stares at a carton of orange juice that says “concentrate” (Erap joke for you). As if only Einsteins can rob and steal! As if lower IQ exonerates her from any wrong doing  – she couldn’t have known better, right? The belief is that Napoles is but a small fish. We have to get to the big fish.

Unfortunately, the government seems to think so. They are more interested in getting its political rivals than punishing the woman who scammed the country. They want to get to the Maestro, the evil manipulator who turned the naive Napoles into the corrupted, vile, woman she is now. Some claim that a scam of this scale is the doing of no one else but JPE, aka Tito Johnny. His fingerprints all over it, Madame Miriam believes. Surely he has the experience, knows the ins and outs of politicking and whatnots, has accumulated vast network of “little birds”..not much different from the GOT’s great manipulator, the spider himself, Lord Varys.

Influence grows like a weed,” Lord Varys said. And for someone as old as JPE, we can say he has had enough time to spread all the weed in the world.. and smoke them too. (OK, I had to try that pun!)Comparing JPE to Lord Varys is a stretch hopefully you can forgive, weed aside- with JPE’s views on masturbation and Lord Vary’s physical condition, surely we can say neither of them is big on jerking off.

Here’s what I think: Giving Napoles a free pass to get to Lord JPE is disgusting, sad and sets a bad precedence. Napoles lied before-and under oath at that. How many chances are we giving this woman? Besides, how do we know the information she intends to share is is crucial to nail Lord JPE? Hasn’t the whistle blower camp enough evidence to nail the bad guys already, without resorting to deals with the devil? Come on, this woman has been bullshitting us for the past year, when is enough enough? Tandaan, ang taong nagigipit..

Senator Alan Cayetano is right :if she’s so sincere about it, why not do it without condition? For all we know, she’s capable of cooking up anything…to save her big fat ass. After all, this woman is, according to whistle blower counsel Levit Baligod, “a con artist” right from the start.

And if she turns state witness, does she promise to return all the stolen money? Surely, we cannot be that forgiving! Return the money and face the consequences. Yes, I agree with Senator Alan Cayetano: we’d like to have our cake and eat it too. That means information AND incarceration. Return all the stolen shit and serve time à la Bernie Madoff. The government should negotiate on their terms-not hers.  What the hell good is cake if you can’t eat it?

Otherwise we send the wrong message : Stealing pays, as long as you repent and ask for forgiveness.

Let’s look at the case in the US: the Ponzi scheme. True, Janet Lim Napoles may not be the Bernie Madoff here, she may simply be the “lieutenant” to the mastermind, like Frank DiPascali is to Mr. Madoff. But Frank Dipascali, who “pleaded guilty to 10 federal charges” still got a sentence, albeit a lighter one, for being the star witness of the prosecution:

Their lawyers argued they had been hoodwinked by Madoff and his lieutenant, Frank DiPascal, who was the prosecution’s star witness against the former Madoff employees.

The jury, made up of nine women and three men, came to their decision after a week of deliberation. Last Monday they asked US district court judge Laura Taylor Swain to review DiPascali’s testimony. DiPascali was one of Madoff’s closest associates and and specifically linked each defendant to the fraud.

In one incident, he told how O’Hara, Perez and Crupi doctored documents that had been hastily printed for outside auditor KPMG by putting them in the freezer and then throwing them around to make them look older.

DiPascali pleaded guilty in 2009 to 10 criminal charges including conspiracy, securities fraud, investment advisor fraud, mail fraud, wire fraud and perjury. He faces a maximum 125-year prison term. He may now receive a lighter sentence in return for his co-operation with federal prosecutors. Ok, fine, it appears that DiPascali got a free pass- after posting a  $10 million bail and spending some prison time…

Bernie Madoff’s right-hand man Frank DiPascali was released on $10 million bail Tuesday. In exchange for his continued cooperation with the FBI and prosecutors, who are still trying to track missing investor funds from convicted Ponzi schemer Madoff’s $65 billion scam, DiPascali has been allowed to go home to his family kin New Jersey wearing an ankle bracelet as he awaits sentencing.

DiPascali, 53, secured the nine required cosigners to secure his $10 million bond. The other bail conditions included securing the bond with $2 million in cash and property, home confinement and electronic monitoring. DiPasclai has been behind bars for more than 10 months since pleading guilty last summer to taking part in Madoff’s scheme. If Napoles can prove that she was not the most guilty of them all, surely we can choose to give her a lighter sentence instead-  lest we teach the wrong lesson : Steal, turn around, rat and get a free pass.

    We are a tad upset, are we? 🙂 I don’t believe Secretary de Lima will grant Janet Napoles any relief except a lighter jail sentence if she makes restitution and is forthright in her testimony. Napoles will leave jail when she is very old, and will forever walk around like Estrada, unable to hide the shame of having been caught as a scoundrel. It is the voters who are anatomically challenged, not the DOJ, it seems to me.

      I hope you are right! Just thinking that Napoles may possibly walk makes me mad. It’s like saying that stealing pays. I really hopewe change the constitution so that those found guilty of stealing public funds get a death sentence. Corruption has been holding our country back, there must be a way to make people think twice about doing it from now on. If we continue to be very forgiving,it sends the wrong message.

        I wish other Filipinos would share your passion for making people accountable. I’m disappointed there have not been riots in the streets demanding the three plundering (at worst) or negligent (at best) senators be suspended.

        Personally, I am fed up. Being overtaxed and with a govt that has nothingt o show for it are the reasons I am staying away. Cases like this make me MAD. Remember Romeo “Ome” Candazo and the scam over 2 decades ago? 20 years and billions of pesos later, we’re back where we started.

        Let’s stop joking ourselves. The previous solutions were to change labels and make some minor modifications. Look where it brought us! It’s like using security patches on an outdated software. It didn’t help before, and it won’t help now. What we need is a new software, one that is less vulnerable and harder to exploit. It’s about time we find ourselves way out of paper bag.
